ANTI-MONEY

LAUNDERING

AND

COMBATING OF TERRORISM FINANCING LAWS

(AMENDMENT) BILL (NATIONAL ASSEMBLY BILL

NO. 5 OF 2025)

Notice is given that the Chairperson of the Departmental Committee on Justice and Legal Affairs intends to move the following amendments to the Anti-Money Laundering and Combating of Terrorism Financing Laws (Amendment) Bill, 2025 at the Committee Stage—

CLAUSE 1

THAT, Clause 1 of the Bill be amended by inserting the words “and shall commence upon publication in the Gazette” immediately after the expression “2025”.

SCHEDULE

THAT, the Schedule to the Bill be amended— (a) in the proposed amendments to section 2 of the Proceeds of Crime and Anti- Money Laundering Act (Cap. 59A) by— (i) deleting paragraph (a) in the proposed insertion of the definition of the term “dealer in precious stones or metals” and substituting therefor the following new paragraph— “(a) mining operations;” (ii) deleting the proposed insertion of the definition of the term “Public Benefit Organizations Regulatory Authority”;

(b) by deleting the proposed amendments to section 55A of the Proceeds of Crime and Anti-Money Laundering Act (Cap. 59A) and substituting therefor the following new amendments— Provision Amendment s. 55A Delete the head note and substitute it with the following new head note—

(c) deleting the proposed amendment to section 55A(1) of the Proceeds of Crime and Anti-Money Laundering Act (Cap. 59A) and substituting therefor the following new amendment— Provision Amendment s. 55A(1) Delete the opening statement of subsection (1) and substitute therefor the following new opening statement—

(1) There is established an advisory board to be known as the Assets Recovery Agency Advisory Board which shall consist of—

(d) in the proposed amendments to the Proceeds of Crime and Anti-Money Laundering Act (Cap. 59A) by inserting the following new amendments in proper chronological sequence— Provision Amendment s. 25(5) Delete paragraph (a) and substitute therefor the following new paragraph—

(a) for a single term of six years and is not eligible for re-appointment; and s. 25(6) Delete.

(e) in the proposed amendments to the Mining Act (Cap. 306), by deleting the word “regulations” appearing immediately after the word “issue” in the proposed new section 16A(2)(g);

(f) in the proposed amendments to the Estate Agents Act (Cap. 533) by inserting the following amendment in proper chronological sequence— Provision Amendment s.18(2) Delete and substitute therefore the following subsection—

(2) A person who contravenes the provisions of this section shall be liable, upon conviction—

(a) in case of a legal person, to a fine not exceeding five million shillings; and

(b) in the case of a natural person, to a fine not exceeding one million shillings.

NEW CLAUSE

THAT, the Bill be amended by inserting the following new Clause immediately after Clause 2— Saving and transition.

Cap. 59A.

1. 3. (1) A person who, immediately before the

commencement of this Act, held office as the Director General of the Financial Reporting Centre shall continue to hold that office as if appointed under section 25 of the Proceeds of Crime and Anti-Money Laundering Act.

(2) The term of a person who continues in office under subsection (1) shall not exceed six years from the date of the second appointment.

LIMITATION OF DEBATE

The House resolved on Thursday, February 13, 2025 as follows-

Limitation of Debate on Bills sponsored by Parties or Committees

THAT, each speech in a debate on Bills sponsored by a Committee, the Leader of the Majority Party or the Leader of the Minority Party be limited as follows:- A maximum of forty five (45) minutes for the Mover, in moving and fifteen minutes (15) in replying, a maximum of thirty (30) minutes for the Chairperson of the relevant Committee (if the Bill is not sponsored by the relevant Committee), and a maximum of ten (10) minutes for any other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen minutes (15) each (if the Bill is not sponsored by either of them); and that priority in speaking be accorded to the Leader of the Majority Party, the Leader of the Minority Party and the Chairperson of the relevant Departmental Committee, in that order.

THAT, each speech in a debate on any Motion, including a Special motion be limited in the following manner: A maximum of three hours with not more than twenty (20) minutes for the Mover and ten (10) minutes for each other Member speaking, except the Leader of the Majority Party and the Leader of the Minority Party, who shall be limited to a maximum of fifteen (15) minutes each, and that ten (10) minutes before the expiry of the time, the Mover be called upon to reply; and that priority in speaking be accorded to the Leader of the Majority Party, the Leader of the Minority Party and the Chairperson of the relevant Departmental Committee, in that order.

THAT, each speech in a debate on Other Committee Reports, including a Report of a Joint Committee of the Houses of Parliament or any other Report submitted to the House for which limitation of time has not been specified, be limited as follows:- A maximum of two and a half hours, with not more than twenty (20) minutes for the Mover in moving and five (5) minutes for any other Member speaking, including the Leader of the Majority Party and the Leader of the Minority Party and the Chairperson of the relevant Committee (if the Committee Report is not moved by the Chairperson of the relevant Committee), and that ten (10) minutes before the expiry of the time, the Mover shall be called upon to reply; and further that priority in speaking shall be accorded to the Leader of the Majority Party and the Leader of the Minority Party, in that order.
