THAT, the Senate adopts the Report of the Standing Committee on Finance and Budget on the County Governments (Equitable Share) Cash Disbursement Schedule for Financial Year 2026/2027, laid on the Table of the Senate on Wednesday, 17th June, 2026 and that, pursuant to Section 17 (7) of the Public Finance Management Act and Standing Order 189 (3), the Senate approves the County Governments (Equitable Share) Cash Disbursement Schedule for Financial Year 2026/2027.

36. MOTION - PROMOTION OF ARTIFICIAL INTELLIGENCE (AI) AND

INNOVATION POLICY IN KENYA

THAT AWARE THAT, the Fourth Industrial Revolution is redefining economies globally through emerging technologies such as Artificial Intelligence (AI), blockchain, and financial technology (Fintech);

FURTHER AWARE THAT Kenya has made commendable strides in digital infrastructure and mobile innovation, positioning itself as a potential leader in Africa’s tech-driven future;

NOTING THAT in a landmark decision, the African Union Executive Council endorsed the Continental AI Strategy during its 45th Ordinary Session in Accra, Ghana, on July 18-19, 2024 to underscore Africa’s commitment to an Africa-centric, development-focused approach to AI, promoting ethical, responsible, and equitable practices;

COGNIZANT THAT the Continental AI Strategy calls for unified national approaches among AU Member States to navigate the opportunities of AI-driven change, aiming to strengthen regional and global cooperation and position Africa as a leader in inclusive and responsible AI development;

APPRECIATING THAT the Ministry of Information, Communications and the Digital Economy recently formulated and launched the Kenya National Artificial Intelligence (AI) Strategy 2025-2030;

RECOGNIZING the need to align Kenya’s development with global standards in AI adoption while also safeguarding national values, inclusivity, and employment;

CONCERNED THAT the absence of a comprehensive framework may hinder innovation among local start-ups and youth-led tech enterprises and slow down Kenya’s ability to harness AI for inclusive growth;

NOW THEREFORE, the Senate resolves that the Ministry of Information, Communication and Digital Economy develops a Policy to promote Artificial Intelligence and emerging technologies with particular emphasis on: i) promoting research and development of locally relevant AI solutions; ii) facilitating ethical guidelines to ensure responsible and beneficial application of AI; iii) creating innovation-friendly ‘Sandboxes’ for supervised testing of AI and emerging technologies; iv) strengthening public-private partnerships to build digital skills and innovation ecosystems; and v) integrating AI and coding into the education curriculum to prepare the next generation for the digital economy.

NOTICE OF AMENDMENTS

A. **THE COUNTY GOVERNMENTS ADDITIONAL ALLOCATIONS BILL

(SENATE BILLS NO. 8 OF 2026)

NOTICE is given that, the Chairperson Standing Committee on Finance and Budget, intends to move the following amendment to the County Governments Additional Allocations Bill (Senate Bills No. 8 of 2026) at the Committee Stage-

CLAUSE 3

THAT clause 3 of the Bill be amended in paragraph (a) by deleting the word “Article” appearing immediately after the words “pursuant to” and substituting therefor the expression “Articles 190 and 202(2)”.

CLAUSE 4

THAT clause 4 of the Bill be amended by deleting subclause (3).

CLAUSE 5

THAT clause 5 of the Bill be amended—

(a) in subclause (2) by inserting the following new paragraphs immediately after paragraph (d)—

(e) conditional allocations for the transition of Universal Health Coverage (UHC) Workers’ salary to permanent and pensionable terms; and

(f) a conditional allocation to the county government of Meru for the settlement of an outstanding arbitral award and accrued interest as set out in Column G.

(b) in subclause (3) by—

(i) deleting the words “Column Q” appearing immediately after the words “as set out in” and substituting therefor the words “Column R”;

(ii) deleting the word “Institutional” appearing immediately after the words “Project (KUSP)-Urban” in paragraph (i) and substituting therefor the word “Development”;

(iii) deleting paragraph (l) and substituting therefor the following new paragraph—

(l) conditional allocations financed by proceeds from an

IFAD

(International Fund for Agriculture Development) loan for the Integrated Natural Resources Management Programme (INReMP) as set out in Column M;

(iv) inserting the following paragraph immediately after paragraph (o)—

(p) conditional allocations financed by proceeds from an IDA (World Bank) loan for the Kenya Watershed Services Project (KEWASIP) as set out in Column Q.

(4A) The conditional allocation under subsection (3)(h) shall be allocated among the county governments on the basis of a criteria to be determined as follows—

(a) each of the eligible forty-five counties will access the UIG, set at a flat rate and made available for the first three years of the Program as follows—

(i) US$250,000 (approximately KSh. 35,500,000) in year 1; (ii) US$200,000 (approximately KSh. 26,000,000) in year 2; and (iii) US$100,000(approximately KSh. 14,200,000) in year 3;

(b) for Window for Host Communities and Refugee (WHR), the grant will be allocated at a flat rate of US$ 500,000, equivalent to KSh. 65,000,000 annually for five years;

(d) failure to satisfy any of the minimum conditions shall disqualify a county from accessing the WHR UIG Grant.

(4B) The conditional allocation under subsection (3)(i) shall be allocated among the county governments based on the financing agreement between the IDA (World Bank) and the Government of Kenya, on the basis of the following criteria- …………../Notice of Amendments

(a) UDG performance allocation of Ksh 2,340 per head using the urban area population data of 2019 census;

(b) UDG Minimum floor of KSh. 52 million; and

(4C) Conditional allocations under subsection 3(n) shall be allocated among county governments on the basis of the following criteria—

(a) the program accounting officer shall, for each eligible transfer to a county government, carry out a performance assessment in accordance with the participatory agreement between the National Government and each eligible county government, through the Annual Performance Assessment Firm;

(b) the Annual Performance Assessment shall determine the eligible county government's performance score for purposes of determining the performance grant allocation;

(c) for each Disbursement Link Indicator (DLI) specified under paragraph (e)(iii), a qualifying county government shall be allocated fifty percent of the Level 2 Grant allocation if it meets that respective DLI result;

(d) the balance of fifty percent under paragraph (c) shall be allocated based on the scores against the performance measures pertaining to each respective DLI result area as detailed in the Program Operational Manual;

(e) the investment grant for a qualifying county government is the sum of the allocation under DLIs 3–7 as follows— (i) DLI 3: Kenya Shillings seventy-five million for each county government that has increased its own source revenue by at least 5 percent annually over and above the rate of inflation; (ii) DLI 4: Kenya Shillings seventy-five million for each county government that has prepared and is implementing an action plan to reduce the stock of pending bills and maintain it at minimal levels;

(iii) DLI 5: Kenya Shillings ninety-seven million five hundred thousand for each county government that has integrated its human resource records, authorized staff establishment and payroll and uploaded cleaned payrolls in the human resource management information system; (iv) DLI 6: Kenya Shillings forty-five million for each county government that is enhancing accountability for results through an integrated performance management framework; and (v) DLI 7: Kenya Shillings sixty million for each county government with a PIM dashboard with citizen feedback mechanisms.

(4D) Conditional allocations under subsection 3(o) shall be allocated to county governments based on Disbursement Linked Indicators (DLIs) and verified results in the approved Results Verification Report (RVR) by an Independent Verification Agent (IVA) hired by the Program, according to the following formula—

(a) with respect to the allocation to the counties of Baringo, Bomet, Kericho, Kirinyaga, Kitui, Kwale, Makueni, Mandera, Migori, Murang'a, Nandi, Narok, Samburu, Tana River, Tharaka Nithi, Vihiga, and West Pokot is C= R1 (938,000 S + 37.38Hw + 4,690Q + 28.14Hs + 1,876VODF +

(b) with respect to the allocation to Turkana and Garissa Counties is C = R1 (938,000S) + R2 (46.62Hw + 7,630Q + 38.15Hs + 1,526VODF + 15,260VCWS + 3,815VSWS)

where —

(i) C is the county allocation (The sum of all 19 county allocations shall be not more than

NEW CLAUSES

THAT the Bill be amended by inserting the following new clauses immediately after clause 8—

Financial misconduct.

9. Despite the provisions of any other law,

a serious or persistent non-compliance with the provisions of this Act constitutes an offence under the Public Finance Management Act.

Exemption.

Cap. 412A.

10. The requirements under sections

191A, 191B, 191C, 191D and 191E of the Public Finance Management Act shall not apply with respect to conditional allocations under this Act in the financial year 2026/2027.

CLAUSE 3

THAT clause 3 of the Bill be amended—

(a) by deleting paragraph (a) and substituting therefor the following new paragraph—

(a) provide for sustainable and environmentally compliant mechanisms for the collection, sorting, refurbishment, repair, reuse, disposal, recycling and material recovery of electrical and electronic products;

(b) in paragraph (b) by deleting the word “improve” appearing at the beginning of the paragraph and substituting therefor the word “safeguard”;

THAT clause 17 of the Bill be amended by deleting subclause (2) and substituting therefor the following new subclause–

(2) The respective county executive committee member shall determine, with the approval of the county executive, the acreage of the e-waste sorting site and its buffer zone by–

(a) undertaking a technical and environmental impact assessment to determine the requisite size of the site and the subsequent impact on the environment; and (b) adhering to the applicable county land use laws.

CLAUSE 18

THAT clause 18 of the Bill be amended by deleting subclause (2) and substituting therefor the following new subclause —

(2) The county executive committee member shall determine in consultation with the respective member of county assembly determine the acreage of the ward consolidation site and its buffer zone by—

NEW CLAUSE 5A

THAT the Bill be amended by inserting the following new clause immediately after clause 5—

Functions of the Authority. 5A. (1) The Authority shall—

(a) develop strategies for proper e-waste disposal and management in the country; (b) mobilize resources for financing of the e- waste management sector; (c) develop standards and guidelines on health measures to be taken by an e-waste practitioner; (d) in consultation with all relevant stakeholders, develop e-waste disposal strategies; (e) conduct periodic reviews on the e-waste disposal strategies; (f) monitor the whole value chain of e-waste management from collection to disposal and propose measures to ensure efficiency; (g) licence national E-waste recycling plants; and (h) conduct e-waste public education and awareness. (2) In exercising the functions under subsection (1), the Authority may- (a) collaborate with local, regional and international organisations in e-waste management; and (b) participate in local, regional and global initiatives for better e-waste management.

NEW CLAUSE 19A

THAT the Bill be amended by inserting the following new clause immediately after clause 19— Exclusion of radioactive waste and nuclear waste.

Cap 243. 19A. (1) This Bill shall not apply to radioactive waste or nuclear waste arising from electrical or electronic equipment or any related activity.

(2) Radioactive waste and nuclear waste shall be managed, transported, stored, and disposed of in accordance with the provisions of the Nuclear Regulatory Act.

NEW CLAUSE 22

THAT the Bill be amended by inserting the following new clause immediately after clause 21— Amendment to Cap 387 C.

22. Section 13 of the Sustainable Waste

Management Act is amended by inserting the following new paragraphs immediately after subclause (2)—

(2A) An importer of a finished product shall pay to the Authority at the point of importation an extended producer responsibility fee as determined by the Cabinet Secretary in consultation with the Authority.

(2B) The Authority shall allocate to counties at least 25% of the prescribed fees collected under subclause (2A).

(2C) County governments receiving allocations under this section shall apply the funds solely for activities related to the environmentally sound management of electronic waste in accordance with this Act.

CLAUSE 2

THAT clause 2 of the Bill be amended— (a) in paragraph (b) of the definition of the words “e-waste practitioner” by deleting the words “the Cabinet Secretary” appearing immediately after the words “section 10 by” and substituting therefor the words “the Authority”;

(b) by inserting the following new definitions in their proper alphabetical sequence –

“refurbishment” means the process of restoring a used or discarded electrical, electronic equipment or component to a functional condition through cleaning, repair, replacement of defective parts, testing and upgrading where necessary for the purpose of reuse;

“repair” means the process of fixing or replacing defective or worn out components of electrical or electronic equipment in order to restore the equipment to proper working condition without substantially altering its original design or functionality;

LONG TITLE

THAT the long title be amended by inserting the words “the reuse, refurbishment, repair” immediately after the words “framework for”.

CLAUSE 5

THAT clause 5 of the Bill be amended by inserting the following new subclauses immediately after subclause (2)—

(3) In exercising the powers conferred by subsection (1), the Cabinet Secretary shall—

(a) consult with communities whose cultural heritage or cultural practices may be significantly affected by the proposed action before making any decision under this Act; and

(b) take into account the particular circumstances and needs of marginalised communities as defined under Article 260 of the Constitution in any matter affecting their respective cultural heritage.

(4) Subsection (3) shall not apply to administrative decisions of a routine or procedural nature.

CLAUSE 6

THAT clause 6 of the Bill be amended by—

(a) renumbering the existing clause as subclause (1); and (b) inserting the following new subclauses immediately after the renumbered subclause (1)—

(2) Each county government shall establish a county cultural committee to advise on the promotion, protection and management of cultural activities and cultural heritage within the county.

(3) In constituting a county cultural committee under subsection (2), the county government shall ensure that the membership—

(a) reflects the diversity of communities within the county, including minorities and marginalised communities as defined under Article 260 of the Constitution; and

(b) includes community elders, traditional knowledge holders and cultural practitioners.

(4) Each county government shall provide such support, including funding, as may be necessary to enable county cultural committees to promote and sustain traditional cultural heritage.

(5) The Cabinet Secretary shall, in consultation with county governments, make regulations prescribing the composition, functions, tenure and procedures of county cultural committees established under subsection (2).

CLAUSE 9

THAT clause 9 of the Bill be amended by deleting subclause (3) and substituting therefor the following new subclauses—

(3) Royalties or compensation paid under this section shall be distributed as follows—

(a) forty per centum to the community whose culture or cultural heritage has been used and which would be administered by the relevant county government;

(b) thirty per centum to the county government within whose jurisdiction the relevant culture or cultural heritage originates; and

(3A) The Cabinet Secretary shall, by notice in the Gazette, prescribe the criteria and procedure for the identification of the communities entitled to receive the community share of royalties or compensation.

(3B) Where a dispute arises as to the communities entitled to receive a share of royalties under subsection (3)(a), the dispute shall be resolved in the manner prescribed by the Cabinet Secretary.

THAT the Bill be amended by deleting clause 7.

THAT clause 12 of the Bill be amended in the proposed new subsection (1) by deleting the word “Senior” appearing immediately after the words “shall be a”.

CLAUSE 24

THAT clause 24 of the Bill be amended in the proposed new section 31(1) by inserting the following new paragraph immediately after paragraph (b) —

(ba) at the end of an audit process on a public entity, there shall be an exit meeting between the officers of the office of the Auditor-General and the accounting officer of the respective entity to deliberate on an issue raised in the audit report.

CLAUSE 31

THAT the Bill be amended by deleting clause 31 and substituting therefor the following new clause—

31. Section 38 of the principal Act

NEW CLAUSES

THAT the Bill be amended by inserting the following new clause immediately after clause 40—

Amendment of section 47 of Cap. 412B. 40A. Section 47 of the principal Act is amended—

(a) in subsection (1) by deleting the word “three” appearing immediately after the words “Auditor-General within” and substituting therefor the word “two”; and

COGNIZANT THAT the Basic Education Act, 2013, the Children Act, 2022, the Occupational Safety and Health Act and the Safety Standards Manual for Schools in Kenya require learning institutions to provide safe and secure environments for learners;

CONCERNED THAT Kenya continues to witness recurrent cases of student unrest, school strikes and arson attacks in schools, leading to loss of lives, destruction of property, disruption of learning and psychological trauma among learners and their families; ……..……/Appendix

ACKNOWLEDGING the findings of the National Crime Research Centre (NCRC), the Auditor General’s performance audit report on Fire Safety Preparedness in Secondary Schools (2020), and the Claire Omolo Task Force Report (2016);

NOW THEREFORE, the Senate resolves that: -

1. the Ministry of Education —

(i) tables in the Senate a status report on the implementation of the various inquiries on school fires including; the Auditor General’s performance audit report on Fire Safety Preparedness in Secondary Schools (2020), the National Crime Research Centre (NCRC) (2016), the Claire Omolo Task Force Report (2016), and the Bombolulu Commission of Inquiry Report (1998);

(ii) Strengthens school infrastructure safety and emergency preparedness by conducting mandatory annual fire safety audits in all boarding schools, allocating resources for improvement of dormitories including installation of emergency exits, firefighting equipment and fire detection systems, and developing clear national evacuation and disaster response protocols;

(iii) develops with modalities of phasing out boarding schools and introducing a hybrid set-up where all schools have both day and boarding arrangements;

(iv) in collaboration with the County governments, maintain sustained intergovernmental investment in modern fire-fighting infrastructure, emergency response equipment, evacuation systems, communication systems, and capacity building for qualified fire safety, disaster management, and emergency response to ensure timely and effective response to fire accidents and emergencies within learning institutions and surrounding communities; and

2. The Teachers Service Commission (TSC) enhances student discipline,

wellbeing and stakeholder engagement; and that

3. Pursuant to Standing Order 228 (4) (a), the Senate Standing Committee

on Education to inquire into the issue of school unrest and arson in schools in the country and table a Report within 90 days from the date of adoption of this Motion.
