Notes on Diagram A

  1. 1. On the Order for Administration of Oath being read, the Senate will remain

seated.

  1. 2. The Clerk will call out the names of the Senators in accordance with the

order of precedence of the Senators, in alphabetical order.

  1. 3. The Senator called by the Clerk will take up his/her position at the Bar of

the House (1st position).

  1. 4. He/she will then proceed along the right of the Dispatch Box to a position

in front on the Speaker’s Chair where he/she will take the Oath/Affirmation (2nd position).

  1. 5. On arrival, the Senator shall state his/her religion to the Clerk.
  2. 6. Having taken the Oath/Affirmation of Office, the Clerk will shake hands

with the Senator who will then proceed to sign the Oath/Affirmation Book (3rd position).

  1. 7. Having signed the Oath/Affirmation Book, the Senator will proceed along

the left side of the Table and go back to his/her seat.

  1. 8. The Order in which Senators will be called is shown on the attached list.

C. PROCEDURE FOR THE ELECTION OF SPEAKER IN ACCORDANCE WITH

THE PROVISIONS OF ARTICLE 106 OF THE CONSTITUTION AND

STANDING ORDERS NO. 4, 5, 6, 7, 8, 9, 10, 11 AND 12

  1. 1. The Clerk will announce the names of the candidates validly nominated

to contest for the office of the Speaker.

  1. 2. The Clerk shall inform the Senate that the names have been entered in

the ballot paper.

  1. 3. Each Senator will receive one ballot paper for the purpose of electing a

candidate.

  1. 4. At the commencement of each ballot, the ballot box shall be displayed to

the Senate, empty and unlocked, after which it shall be locked and placed on the Table.

  1. 5. When all Senators present have voted, the Clerk shall unlock the box,

examine and count the ballot papers and having rejected ballot papers not marked in accordance with the Standing Orders, announce the results of the ballot.

  1. 6. During examination and counting of the ballot papers, each candidate

shall be allowed to nominate a Senator to witness the exercise, on behalf of and as the candidate’s agent.

  1. 7. (1) A person shall not be elected as Speaker, unless supported in a ballot

by the votes of two-thirds of all Senators.

(2)If no candidate is supported by the votes of two-thirds of all the Senators, a fresh election shall be held and in that election, the only candidates shall be:-

a) The candidate or candidates who received the highest number of votes in the ballot referred to in paragraph (1); and

b) The candidate or candidates who in that ballot received the next highest number of votes.

(3)If more than one candidate receives the highest number of votes, paragraph (2) (b) shall not apply and the only candidates in the fresh election shall be those contemplated in paragraph 2(a).

(4)The candidate who receives the highest number of votes in the fresh election shall be declared elected as Speaker.

  1. 8. If in the further ballot referred to in 6 above, more than one candidate

receives the highest number of votes, the ballot shall again be taken, and if there is equality of the highest number of votes, a further ballot shall be taken until one candidate obtains more votes than the other or others. …….…….……./Appendix

D. PROCEDURE FOR THE ELECTION OF THE DEPUTY SPEAKER IN

ACCORDANCE WITH THE PROVISIONS OF ARTICLE 106 OF THE

CONSTITUTION AND STANDING ORDER NO. 13

In accordance with the provisions of Standing Order 13 (2), the Speaker shall preside over the election of the Deputy Speaker. The procedure for electing the Deputy Speaker shall, with necessary modifications, be the same as that prescribed for the election of the Speaker.

2) Gazette Notice No. 10537 dated 7th September, 2022, containing the names of the persons nominated as Senators, pursuant to Article 98(1)(b), (c) and (d) of the Constitution.
