1. 14. MOTION - STOPPAGE OF FUNDS TO ISIOLO COUNTY DUE TO THE

FAILURE BY THE GOVERNOR TO HONOUR SENATE SUMMONSES

THAT AWARE THAT, pursuant to Article 96 of the Constitution, the Senate represents the counties and serves to protect the interests of the counties and their governments, and that the Senate exercises oversight over national revenue allocated to the county governments;

FURTHER AWARE THAT, Article 124 of the Constitution establishes Committees to carry out specific mandates and that Article 125 of the Constitution gives any Committee the power to summon any person to appear before it for the purpose of giving evidence or providing information;

WHEREAS, the Senate Standing Committee on Health invited and later summoned the Governor of Isiolo County, Hon. Abdi Ibrahim Hassan, to respond to questions relating to, among others, the ongoing crisis at Isiolo Morgue, NHIF deductions and remittance status and total amount of pending bills owed to the county hospital, which invitation he failed to honour on 21st May, 2024 and similarly failed to honour the summonses on 28th May, 2024 and 10th June, 2024;

AND WHEREAS the Governor of Isiolo County failed to honour an invitation by the County Public Investments and Special Funds Committee to respond to issues raised in the Auditor-General’s Reports on Isiolo County Bursary Fund, the Isiolo County Emergency Fund and the Isiolo County Youth, Women and People with Disability Fund for the Financial Years 2019/2020, 2020/2021 and 2021/2022 on 28th May, 2024;

AND FURTHER WHEREAS the Governor of Isiolo County failed to honour five (5) invitations on diverse dates between 28th March, 2023 and 8th March, 2024 by the County Public Accounts Committee to respond to queries raised by the Auditor General in the Financial Statement of the County Executive of Isiolo for the Financial Years 2019/2020 and 2020/2021;

CONCERNED THAT following the numerous incidents of failure and or refusal by the Governor of Isiolo County to honour invitations and summonses, the County Public Accounts Committee scheduled for a meeting at Isiolo County offices on 8th March, 2024 which the Governor failed to attend;

FURTHER CONCERNED THAT the committees of the Senate, pursuant to Article 179 (4) of the Constitution, invited Governor Abdi Ibrahim Hassan in his capacity as the Chief Executive Officer of the County, and he failed and/ or refused to appear before the committees to answer the respective audit queries raised by the Auditor-General with respect to whether or not public monies have been applied lawfully and in an effective manner by the county government;

NOW THEREFORE, THE SENATE RESOLVES THAT –

1) pursuant to Article 228 (4) and (5) of the Constitution, the Controller of Budget should not authorize any withdrawal of public funds by the County Government of Isiolo until the Governor has responded to the issues raised in the summonses to the satisfaction of the Senate; and

2) the National Treasury, pursuant to Article 225 of the Constitution and Section 96 of the Public Finance Management Act, stops forthwith the transfer of funds to the County Government of Isiolo.

b. Where does the convenience fee charged and all other payments that fail to reflect on the platform end up?

c. a. What was the allocation for development expenditure in the National Government budget for the Financial Year 2022/2023, and could the Cabinet Secretary indicate the percentage of the expenditure that was financed by Government’s ordinary revenue, loans and grants from development partners?

b. How much of the development expenditure was spent on pending bills for projects commenced and/ or completed in preceding financial years, and could the Cabinet Secretary provide a list of these projects along with their corresponding amounts?

c. Could the Cabinet Secretary provide a list of all development projects undertaken by the National Government in the said financial year, specifying their names, sectors, locations, corresponding expenditure, completion dates and indicate whether each project was initiated in the said financial year or preceding financial years?

d. Could the Cabinet Secretary provide details on all conditional grants by the National Government to the counties in the said financial year, including the project names and the corresponding amounts, beneficiary counties and any funding partners involved?

e. Were there any additional development funding or aid from development partners in the said financial year and, if so, could the Cabinet Secretary specify the amount and the projects funded along with their respective locations?

Question No. 088 Nominated Senator (Sen. Joyce Korir, MP) to ask the Cabinet Secretary for the National Treasury and Economic Planning:

a. Could the Cabinet Secretary explain the inordinate delay in processing and disbursing pension benefits to retired civil servants and state why Mr. Stephen Kipyegon Turgat (TSC No. 073576) and Mr. Jonathan Kiptanui Lang’at (TSC No. 069710), who retired in 2001, are yet to receive their pension?

a. Could the Cabinet Secretary provide a status update on the payment of terminal dues to all former employees of the Pan African Paper Mills Company Limited in Webuye, who were in employment at the time the company was placed under receivership in March, 2009?

b. Could the Cabinet Secretary explain the reasons for the delay in payment as well as the projected timelines for the same?

c. What is the Government doing to expedite payment of terminal benefits to the former staff?

Question No. 051 The Senator for Nandi County (Sen. Samson Cherarkey, MP) to ask the Cabinet Secretary for Labour and Social Protection: a. What are the roles of the National Employment Authority (NEA) in the recruitment of Kenyans seeking job opportunities in foreign countries and could the Cabinet Secretary state the requirements to be met by a recruitment agency to be permitted to operate by NEA?

b. Could the Cabinet Secretary provide a list of recruitment agencies cleared to operate by NEA and what steps are used to ensure that all companies registered under the National Employment Authority Integrated Management System (NEAMIS) are monitored and regulated? …………../Appendix

What is the status of the investigations into the operations of Ms Worth Start Africa Limited, an agency operated by one Pastor James Wanjohi, that reportedly defrauded Kenyans of over Kshs. 600 million with a promise to assist them secure jobs, and could the Cabinet Secretary state the plans, if any, to compensate them?

Question No. 085 The Senator for Machakos County (Sen. Agnes Kavindu, MP) to ask the Cabinet Secretary for Labour and Social Protection: Could the Ministry consider collaborating with the Consortium of the 7th August 1998 Victims to identify and enroll surviving Kenyan victims of the 1998 bombing of the United States of America Embassy in Nairobi into the social assistance programmes currently being implemented by the Ministry? Question No. 061 The Senator for Kisumu County [Sen. (Prof.) Tom Odhiambo Ojienda, SC, MP] to ask the Cabinet Secretary for Roads and Transport: a. Is the Ministry currently undertaking real-time mapping of all roads, bridges and other transport infrastructure affected by the April/ May 2024 unprecedented rains and floods and, if so, could the Cabinet Secretary provide a list of all affected transport infrastructure across the country?

b. What flood mitigation measures are required to bring each affected infrastructure to a state where it can withstand the rains and floods currently being witnessed in the country, and what are the budgetary implications for such improvements?

c. Could the Cabinet Secretary outline the obligations of the National Government vis-à-vis those of the County Governments regarding the reconstruction of each transport infrastructure affected by the floods?

b. Why has there been a delay in compensating some of the landowners, and could the Cabinet Secretary state when the affected landowners will be paid?

c. What measures has the Ministry put in place to guarantee timely compensation of individuals affected by road construction projects in future?

Question No. 065 The Senator for Kakamega County (Sen. (Dr.) Boni Khalwale, CBS, MP) to ask the Cabinet Secretary for Roads and Transport:

a. Could the Cabinet Secretary provide a list of landowners who granted wayleave for the upgrading to bitumen standard of the Sigalagala-Butere road and indicate the respective amounts due as compensation to each?

Why has there been a delay in the upgrade of Kimbimbi- Kanjinji-Togonye-Piai Road, Kagumo-Kiamaina- Gathuthuma Road and Piai-Njukiini-Kiamutugu- Karumandi-Kiamiciri Road, popularly known as Mucibi wa Gichugu, to bitumen standard, despite their importance in enhancing the economic potential of the region?

Question No. 067 The Senator for Kirinyaga County (Sen. James Murango, MP) to ask the Cabinet Secretary for Roads and Transport: a. Are there plans by the Government to upgrade Wang’uru Airstrip in Mwea Constituency, Kirinyaga County for use by, among others, horticulture and miraa farmers to transport their produce and, if so, could the Cabinet Secretary state whether an allocation for that purpose has been made in the 2024/ 2025 financial year budget?

b. Could the Cabinet Secretary outline the policy measures implemented by the Government to develop air transport in the country, and particularly in Kirinyaga County?

c. What steps has the Ministry taken to construct airstrips in all counties where there are none?

Question No. 074 Nominated Senator (Sen. Peris Tobiko, MP) to ask the Cabinet Secretary for Roads and Transport: a. Could the Cabinet Secretary provide a status update on the construction of the road off Mombasa Road from the Daystar University junction to Stoni Athi, stating the scope of works and indicating when the project will be completed?

Why are there no proper markings and signage on the Kenol-Sagana-Marwa Road near social amenities such as schools, and could the Cabinet Secretary state when such markings will be drawn and signage put up?

Could the Cabinet Secretary state when the footbridge at Kenol town will be competed and clarify whether there are plans to construct a footbridge near Komorori Primary School, to serve the 1700 pupils and teachers of the school, who currently have to walk for approximately a kilometre to cross the road?

c. When will the construction of the said road be completed?

Question No. 081 The Senator for Tharaka-Nithi County (Sen. Mwenda Gataya Mo Fire, MP) to ask the Cabinet Secretary for Roads and Transport:

a. Could the Cabinet Secretary explain the inordinate delay in completing the tarmacking of the Gatunga-Chakariga Road, which was commissioned in 2014 and is critical in connecting Tharaka South and Tharaka North sub- counties, and also links Tharaka University to the rest of Kenya?

b. Could the Cabinet Secretary provide a detailed assessment of the quality of works done so far and explain why there is visible damage in sections of the road that were already tarmacked, and also state when the sections will be repaired?

c. When will the contractor, who has already left the construction site, resume works on the road, and could the Cabinet Secretary indicate when the project will be completed?
